Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Resolvent Technologies, Inc. (“Resolvent,” “we,” “us”), the company that makes Drift. They cover the Drift mobile app and the driftnightly.com website (together, the “Service”). Please read them carefully.
1. Acceptance of these Terms
By downloading, installing, or using Drift, or by using driftnightly.com, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
If you are under 18, or under the age of majority where you live, you may use Drift only with permission from a parent or guardian, who agrees to these Terms on your behalf.
2. The Service
Drift is a sleep-stories app. It plays calm, narrated stories meant to help a busy mind wind down at bedtime, with a sleep timer that fades the story out or lets it play all night. The stories are narrated with a synthetic (computer-generated) voice.
Drift has no accounts and no sign-in. Your listening history and settings stay on your phone; our Privacy Policy explains what does and doesn’t leave it. Drift is offered in the United States, for personal, non-commercial use. We may add, change, or remove stories and features over time.
3. Subscriptions & free trials
Free to start. Drift is free to download and includes a limited number of free plays. After that, you need a subscription to keep listening.
Plans. We currently offer two plans:
- Monthly: $7.99 per month.
- Yearly: $49.99 per year.
The App Store or Google Play shows you the price before you confirm a purchase.
Free trial. Each plan comes with a 14-day free trial for new subscribers. Apple or Google decides whether you are eligible; for example, if you have already had a Drift trial or subscription, you may not get another. If you don’t cancel at least 24 hours before the trial ends, your subscription starts and you are charged for the plan you chose.
Billing. Apple (through the App Store) or Google (through Google Play) bills you, not Resolvent. Payment is charged through the App Store or Google Play when you confirm a purchase or when a free trial ends, and the store’s own terms also apply to your purchase. We never receive your card details.
Auto-renewal. Your subscription renews automatically at the end of each month or year, at the then-current price, until you cancel. To stop the next charge, cancel at least 24 hours before the current period ends.
How to cancel. Manage or cancel your subscription in your store’s subscription settings:
- iPhone or iPad: Settings → your name → Subscriptions.
- Android: the Google Play Store app → your profile icon → Payments & subscriptions → Subscriptions.
Deleting the app does not cancel your subscription. When you cancel, you keep access until the end of the period you have already paid for, and you are not charged again.
Refunds. Apple and Google handle refunds under their own policies. To ask for a refund, contact the store you bought from. If the law where you live gives you a right to a refund or to cancel, that right still applies.
Price changes. We may change subscription prices. You will get notice in advance, through Apple or Google as their rules require, and a new price applies from your first renewal after that notice. In some cases the store will ask you to agree to the new price, and if you don’t, your subscription ends at the end of the current period. If you don’t want to pay a new price, cancel before it takes effect.
4. Acceptable use
You agree not to:
- Copy, record, redistribute, sell, or publicly perform Drift’s stories or audio.
- Reverse engineer, scrape, or try to extract our content or source code, except where the law allows it.
- Get around the free-play limit, the subscription, or our security measures.
- Use the Service unlawfully, or in a way that infringes anyone else’s rights.
- Interfere with or disrupt the Service or the servers that deliver it.
5. Content & intellectual property
Resolvent owns Drift: the app, the stories (their text and audio), the designs, and the Drift name and logo. They are protected by copyright, trademark, and other laws. The open-source software components inside the app are covered by their own licenses.
As long as you follow these Terms, we give you a limited, personal, non-exclusive, non-transferable, revocable license to use the app and listen to the stories on devices you own or control, for your own non-commercial use. All rights not expressly granted are reserved.
6. Not medical advice
Drift is a wellness product, not medical advice, diagnosis, or treatment. It is not intended to diagnose, treat, cure, or prevent any condition, including insomnia, anxiety, or ADHD, and it is not a substitute for professional medical care. If you have a sleep disorder or any health concern, or if sleep problems persist, talk to a qualified healthcare professional. 7. Apple App Store users
If you got Drift from the Apple App Store, Apple’s standard Licensed Application End User License Agreement applies to your use of the app, alongside these Terms. These Terms are between you and Resolvent, not Apple. Apple is not responsible for Drift or its content and has no obligation to provide maintenance or support for it. Questions, complaints, and claims about Drift should come to us.
8. Disclaimer of warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that it will produce any particular result, including better sleep.
9. Limitation of liability
To the maximum extent permitted by law, Resolvent will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, sleep, profits, or goodwill, arising from your use of or inability to use the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid for Drift in the twelve months before the claim or USD $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
10. Indemnification
You agree to indemnify and hold Resolvent harmless from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Service or your violation of these Terms.
11. Ending these Terms
You can stop using Drift at any time by deleting the app. If you have a subscription, also cancel it in your store settings (see Section 3) so you aren’t charged again. We may suspend or end your access if you violate these Terms or to protect the Service. Sections that by their nature should survive (including intellectual property, the disclaimers, limitation of liability, and governing law) will survive.
12. Changes to these Terms
We may update these Terms from time to time. We will post the new version on this page with a new effective date and, for material changes, take reasonable steps to let you know, such as a notice on this site. If you keep using Drift after the changes take effect, you accept the updated Terms.
13. Governing law & disputes
These Terms are governed by the laws of the State of Louisiana, United States, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located there, unless applicable consumer-protection law gives you the right to bring a claim elsewhere. Nothing in these Terms limits any mandatory consumer rights you have under local law.
